1.1 This Agreement is between Copenhagen Staff ApS (“Copenhagen Staff”, “we”, “us”) and the individual registering as a worker on our platform (“Worker”, “you”).
1.2 By completing the registration process on our website and ticking the acceptance box, you confirm that you have read, understood, and agree to be bound by this Agreement in its entirety.
1.3 This Agreement governs the terms under which Copenhagen Staff may, at its sole discretion, offer you individual shift assignments and the terms under which you may accept or decline those assignments.
2.1 No employment guarantee. Registration with Copenhagen Staff does not constitute an offer of employment, a contract of employment, or any guarantee of work. Copenhagen Staff is under no obligation to offer you any assignments, and you are under no obligation to accept any assignments offered.
2.2 On-call casual engagement. Copenhagen Staff operates a genuine on-call casual staffing model. Each individual shift assignment constitutes a separate, standalone engagement. There is no mutuality of obligation between assignments — meaning Copenhagen Staff has no obligation to offer you future work, and you have no obligation to make yourself available or accept any offer of work.
2.3 Separate engagements. Each assignment is a distinct and independent engagement. The completion of one assignment creates no right, entitlement, expectation, or implied obligation to any future assignment.
2.4 No permanent employment relationship. Nothing in this Agreement or in the pattern of assignments offered and accepted shall be construed as creating a permanent employment relationship, a relationship of continuous employment, or an expectation of regular or ongoing work.
2.5 Tripartite relationship. When assigned to a client, you will work under the direction and supervision of the client (User Company) at their premises. Copenhagen Staff remains your employer of record for the duration of each assignment. The client is not your employer.
3.1 When an assignment becomes available that matches your registered profile, Copenhagen Staff may contact you via the contact details you have provided.
3.2 Assignment details will include: the client venue, date, start time, expected end time, role, and applicable rate of pay for that specific assignment.
3.3 You must confirm acceptance or non-acceptance promptly. Copenhagen Staff reserves the right to offer the assignment to another worker if you do not respond within the timeframe specified in the offer.
3.4 Once you have confirmed acceptance of an assignment, you are committed to fulfilling it. Non-attendance without valid reason and reasonable advance notice will constitute a breach of this Agreement and may result in removal from the Copenhagen Staff platform.
3.5 Copenhagen Staff reserves the right to withdraw an assignment offer at any time prior to your acceptance, and to cancel a confirmed assignment with reasonable notice where circumstances require, including but not limited to cancellation by the client.
4.1 Shift-by-shift basis. Pay rates vary by assignment and will be communicated to you clearly at the time of each assignment offer. There is no fixed or guaranteed rate of pay across assignments.
4.2 Equal treatment. In accordance with the Danish Act on Temporary Agency Workers (Vikarloven, implementing EU Directive 2008/104/EC), your pay and basic working conditions for each assignment will be no less favourable than those of comparable employees directly employed by the client in the same or similar role.
4.3 Holiday allowance. You will receive holiday pay (feriegodtgørelse) in accordance with the Danish Holiday Act (Ferieloven). Holiday pay is accrued at 12.5% of your total gross earnings and will be paid in accordance with Danish law.
4.4 Minimum shift duration. The minimum payable shift duration is 4 (four) hours per assignment. If an assignment ends before 4 hours have elapsed, you will still be paid for a minimum of 4 hours, provided you attended and were ready to work.
4.5 Payment schedule. Payment for completed shifts will be processed on a regular schedule as communicated by Copenhagen Staff. Payment is made via bank transfer to the account details you provide upon registration.
4.6 Accuracy of hours. You are responsible for ensuring that the hours you have worked are accurately recorded in the manner specified by Copenhagen Staff for each assignment. Disputes regarding hours worked must be raised within 48 hours of the shift completion.
4.7 Tax and social contributions. Copenhagen Staff will handle statutory deductions including income tax (A-skat) and labour market contributions (AM-bidrag) where applicable. You are responsible for ensuring your tax registration details (CPR number or equivalent) are accurate and up to date.
5.1 Working hours for each assignment will comply with the Danish Working Time Act (Arbejdstidsloven), including the maximum 48-hour average weekly working time, minimum 11 consecutive hours rest per 24-hour period, and minimum one 24-hour rest period per week.
5.2 Working hours for each assignment will be registered in accordance with the requirements of the Danish Working Time Act as amended from 1 July 2024.
5.3 You must arrive at the assignment location on time, dressed appropriately, and prepared to work in accordance with the standards and requirements communicated to you by Copenhagen Staff.
5.4 During your assignment you are under the direction and supervision of the client. You must follow reasonable instructions from the client's management, provided those instructions do not require you to act unlawfully or unsafely.
6.1 While working on the client's premises during an assignment, you are covered by the client's workplace insurance (arbejdsskadeforsikring) in accordance with the Danish Act on Workers' Compensation (Arbejdsskadesikringsloven).
6.2 You must comply with all health and safety rules, procedures, and instructions at the client's premises during your assignment.
6.3 You must report any accident, injury, near-miss, or unsafe condition to the client's site supervisor immediately and notify Copenhagen Staff as soon as practicable.
6.4 Copenhagen Staff accepts no liability for accidents, injuries, or incidents occurring at the client's premises that are caused by the client's equipment, premises, or working environment, or by your own failure to follow health and safety instructions.
7.1 You are required to maintain professional conduct at all times during assignments, including but not limited to: punctuality, appropriate dress, respectful behaviour towards clients, their staff, and their customers, and compliance with the client's internal policies and procedures.
7.2 You must not attend an assignment under the influence of alcohol or any non-prescribed substance.
7.3 You must not disclose confidential information about clients, their operations, customers, or business to any third party during or after an assignment.
7.4 You must not engage in any conduct that could damage the reputation of Copenhagen Staff or the client.
7.5 Breach of these conduct standards may result in immediate termination of the current assignment and removal from the Copenhagen Staff platform, with no entitlement to payment for incomplete shifts where the breach constitutes gross misconduct.
8.1 Copenhagen Staff reserves the right to remove you from the platform and cease offering assignments at any time, including but not limited to: poor performance, conduct issues, negative client feedback, failure to attend confirmed assignments, or provision of false information upon registration.
8.2 You may withdraw from the platform at any time by notifying Copenhagen Staff in writing. Withdrawal does not affect your entitlement to payment for completed assignments or accrued holiday pay.
8.3 Removal from the platform does not constitute dismissal from employment given the on-call casual nature of this arrangement.
9.1 Copenhagen Staff processes your personal data in accordance with the Danish Data Protection Act (Databeskyttelsesloven) and the EU General Data Protection Regulation (GDPR).
9.2 Your personal data will be used for the purpose of managing your registration, offering assignments, processing payroll, and meeting our legal obligations. We will not share your data with third parties except as necessary to fulfil assignments or as required by law.

10.1 Copenhagen Staff's liability to you in connection with any assignment or this Agreement is limited to the pay owed to you for hours validly worked and confirmed.
10.2 Copenhagen Staff accepts no liability for loss of earnings arising from cancellation of assignments, failure to be offered assignments, or removal from the platform, except where required by applicable Danish law.
10.3 Nothing in this Agreement limits Copenhagen Staff's liability for death or personal injury caused by our gross negligence, or for any other liability that cannot be excluded by Danish law.
11.1 This Agreement is governed by and construed in accordance with the laws of Denmark.
11.2 Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the Danish courts.
12.1 Copenhagen Staff reserves the right to amend these terms at any time. You will be notified of material changes via email or through the platform. Continued use of the platform following notification constitutes acceptance of the updated terms.
